Rules and Regulations

  • Lots in the Cemetery are conveyed for burial purposes only, subject to such rules and regulations as are now or hereafter put in force by the Management.
  • No burials will be permitted in the Cemetery without a permit from proper authorities. Burial orders must be signed by persons ordering burials before graves are opened. Graves must be paid for before they are opened. Concrete Liner or steel vaults must be used with all burials.

  • The Management reserves  the right to exclude from any lot, any headstone, monument, or other structure, trees plastic or real flowers, plants or other object, which may conflict with the regulations, or which may be considered injurious to the general appearance of the grounds, lawns or plots. All floral arrangements are to be placed in an approved container.  No glass containers are allowed.  All vases have to be approved by the Cemetery Director.  Non approved containers will be removed.
  • No person or persons not employed by the Cemetery authorities shall excavate any earth, lay or remove any sod alter the grade of any lot within the Cemetery either on or about his own lot or the lots of others, or plant, remove or trim any tree or shrub.

  • The Cemetery shall in no way be held liable for any injuries sustained by anyone while in the Cemetery.
  • No curbing or masonry of any description shall be placed or installed, nor shall any trees, shrubs or flowers of any kind be planted on any of the property herein granted, except by written consent of the Management, which consent is hereby reserved.

  • Management shall fix the size and sale price of grave spaces, fix the price of opening graves and disinterments. Information with reference thereto will be given upon inquiry from the Cemetery Director..

  • Graves opened or burials made on Saturday require a 24 hour advance notice.

  • No transfer for any property in said Cemetery shall be legal unless made in the office of and signed by the Cemetery Director.

  • All markers, stones, or monuments must be approved by the Cemetery Director.

  • No interment shall be permitted or memorial placed in or on any property not fully paid for.
  • The Management reserves the right of passing other rules and regulations, or amending these rules and regulations at any time the occasion arises

  • Dogs are not allowed on the Cemetery grounds.
  1. Rules
    1. The Cemetery will be open to visitors at sunrise and will be closed at sunset.  Office hours are from 8:00 A. M. to 4:30 P. M.  Monday through Friday.  Saturdays 8:00 A. M. to 12:00 noon.  Closed Sundays.  Visitors will not be allowed after sunset except by permission of the Cemetery Director or his designee.
    2. No vehicle shall be operated in any part of the cemetery, except upon the paved avenues, and at speeds no faster than 10 miles per hour. All funeral processions, while within the grounds, will be subject to the direction of the Cemetery Director or his designees.
    3. No person shall gather flowers, either wild or cultivated, on the premises, or remove, cut, break, or mark any tree, shrub, or plant; or mark upon, deface, or injure any monument or any other structure on the grounds.
    4. Firearms shall not be discharged in the cemetery, except for salutes at military funerals, Memorial Day ceremonies, or by direction of the Cemeteries Trustees.

    Any person disturbing the quiet and/or good order of the grounds by loud noise, speeding, or other improper or disorderly conduct, or who shall violate any of the rules, will be expelled from the grounds by the Cemetery Director, and such person will be dealt with as provided by law. Management prohibits  the entrance of any intoxicated or improper person.
     

  2. Interments
    1. Burial lots in the cemetery shall be used for no other purpose than a place for the interment of the human dead, or marker monuments. All memorial structures must be approved by the Cemetery Director.
    2. No interment or disinterment shall be made until the Cemetery has been furnished with a permit, such as may be required by the laws of the State of New Mexico, together with an order from the legal owner, or the legal representative, of the right of burial in the lot in which interment is to be made or was made. No grave shall be opened for interment or removal, by any person not in the employ of Memorial Pines Cemetery.
    3. All interments shall be enclosed in a concrete liner or steel vault except infants. Cremations require an urn or suitable container.
    4. Burials will be from Monday to Friday from 8:00 a.m. to 3:00 p.m.  If the service arrives after 3:00 p.m. there will be an overtime charge of $75.00 every half hour but no later than 5:00 p.m.  No services will be held after 5:00 p.m. during the week.  On Saturdays the services will be from 8:00 a.m. to 10:30 a.m.  If the arrival time is after 10:30 a.m. there will be an overtime charge of $75.00 and if the service arrives after 11:00 a.m. the charge will be $150.00.  For services that will be arriving after 12 noon on Saturdays, please contact Cemetery director prior to making arrangements for adjustment of overtime charges. Overtime charges are subject to change without notice.
       
  3. Cemetery Lots
    1. The Management shall, upon request, furnish to residents who desire to purchase rights of burial in lots or graves, information relative to the cost of same and the conditions upon which interments may be made.
    2. The owners of rights of burial, or their heirs, shall not grant, sell, alienate, or convey, the said exclusive right of burial, to any person or persons, without having first obtained the written approval and consent of the Cemetery Director; but it shall be the option of the Cemetery Director to grant or withhold such approval and consent.
    3. All work performed on graves or lots by the owners, or by their order, shall be under the supervision of the Cemetery Director or his designee in order to preserve as much as possible the natural appearance of the cemetery.
    4. No wood, metal, wire, hedge or other fence material shall be erected or maintained on or around any lot unless approved by the Cemetery Trustees.
    5. Masons, stone-cutters and all workmen, shall at all times be under the control of the Cemetery Trustees or their designee and must carry off all rubbish and restore the roads, paths and avenues injured by their operations. Any workmen failing to conform to these rules may be excluded from the grounds and the person employing him shall be responsible for the injuries sustained through neglect.
    6. Only persons with cemetery business are permitted on the cemetery grounds. No dogs or motorized vehicles are allowed on the grounds.
       
  4. Markers, Headstones and Monuments
    1. All work done in Memorial Pines Cemetery is done under the rules approved by the Board and the  supervision of the Cemetery Director.
    2. No monument or marker shall be erected in Memorial Pines Cemetery until the material, style and inscription have been approved by the Cemetery Director.
    3. Only granite shall be allowed. The base of each monument must be level on the bottom so as to set solid and erect on the foundation.  All foundations and monuments must be installed by the Cemetery monument contractor and are subject to the final approval of the Cemetery Director.
    4. No monument shall be allowed on any lot not paid for in full.
    5. Flush markers, Slant markers, and upright monuments are permitted at the discretion of the Cemetery Director. Military markers or monuments supplied by the Government may be upright or flush with the ground.
    6.  Installation fee for outside markers will be $250.00 effective September 10, 2003 and are subject to revision or change every six    months.      For flush, slant and upright markers, the installation fee will be based on size and weight starting from $300.00 and up.  Markers brought from outside vendors will not be warranted for any reason.
    7.  After a period of three years of interment if there is no headstone purchased or installed, anybody else other than the lot owner can purchase the headstone.  Ownership of land will not change.  (Effective January 1, 2007)
    8.  For infants or children:  both parents have the right to purchase the headstone even if one or neither are listed as the property owner or person making arrangements.  (Effective January 1, 2007)
